Penegakan Hukum Terhadap Pelaku Penyelundupan Penyu Di Kabupaten Kepulauan Aru

Abstrak
Penangkapan penyu di Kepulauan Aru menimbulkan permasalahan, karena penyu mempunyai nilai jual yang cukup mengiurkan para penangkap penyu, padahal penyu merupakan binatang yang dilindungi oleh Negara. Untuk itu penulis melakukan penelitian dengan memakai metode yuridis normatif, dengan tipe penelitian deskriptif analitis, sumber hukum yang dipakai adalah bahan hukum primer dan sekunder untuk memperoleh hasil. Hasil penelitian menujukan ada faktor mempengaruhi mulai dari faktor peraturan perundang undangan, faktor penegakan hukum, faktor masyarakat, faktor sarana dan fasilitas, sampai pada faktor adat istiadat yang mempengaruhi penangkapan penyu.
AbstractThe capture of sea turtles in the Aru Arcipelago problems, because turtles have a selling value that is enough to lure turtle catchers, even though turtles are animals protected by the State. For this reason the author conducted a study using normative juridical methods, with the type of analytical descriptive research, the legal sources used were primary and secondary legal materials to obtain results. The results of the study show that there are influencing factors ranging from the factors of legislation, law enforcement factors, community factors, factors of facilities and facilities, to the customs factors that affect the capture of turtles.
